Mr. Fincher only handles civil matters. While his primary focus is on representing people and businesses in contested and complex lawsuits, he also advises clients on a wide range of non-litigation matters, including contracts, employment matters, and wills and estate planning.
Family Law
Family law is the branch of civil law that deals with marriage, divorce, annulment, child custody, adoption, birth and any other issues affecting families.
Divorce: Divorce, also called dissolution of marriage, is the termination of a marital union, canceling the legal duties and responsibilities of marriage and dissolving the bonds of matrimony between two people.
Child Custody: A child custody order refers to any court order that sets out how decisions are made for a child or children involved in family law cases.
A child custody order refers to any court order that sets out how decisions are made for a child or children involved in family law cases. While most parents will agree on what is in the best interest of their children, there may be situations where parents disagree about the type of custody that would be appropriate for their children.
Generally, a judge will determine which parent will receive primary and secondary custody based on the best interests of the child factors that are set forth by statute. The court considers several factors when determining whether joint or sole custody is appropriate such as:
- Each parent's willingness and ability to allow and encourage frequent and continuing contact with the other parent;
- The age and number of children;
- Whether there has been domestic violence or abuse between either spouse;
- Any history of parental kidnapping;
- The geographical proximity of the parents' homes (if this applies);
- The financial status and needs of each party (including tax consequences).
- Any previously agreed upon arrangements may be considered.
The judge will also determine other custody issues including: The amount of time each parent is allowed to spend with the children; Who pays for certain expenses like transportation, clothing, and medical bills; Whether a child support order is necessary.
Pre-Nuptial Agreement: A prenuptial agreement (also known as an ante-nuptial agreement) is a contract signed by two people who plan to marry describing what will happen to their property in the event of divorce or death. It's often used to protect ownership rights over things like houses and businesses.
Contract Law
Contract law deals with agreements between two or more parties, each of which is obligated to hold up their portion of the agreement.
It is vital that anyone who enters into a contract understand what they are agreeing to, and the consequences of not fulfilling their end of the bargain.
A contract can be oral or written, but it must include all of the elements of a valid contract in order to be enforceable. Content: Elements of a valid contract include an offer, acceptance of that offer, and consideration. These three elements must be present for the agreement to be considered legal and binding.
Consideration is often confused with "bargaining," which does not need to take place for consideration to exist in a valid contract. Consideration simply means that each party has exchanged something valuable - whether it's cash, services rendered or promises made - for the promise from the other party that he/she will fulfill their end of the bargain when needed.
Each party entering into a contract should have his/her own independent legal counsel review the document before signing it - even if they are on good terms with their future business partner at the time they sign it – because things change and people fall out over business deals all the time.
